REGULATIONS FOLKLORIC COMPETITION

52nd International Singing Festival of Viña del Mar 2011.

The Promotion Committee of the 52nd International Singing Festival of Viña del Mar announces this folkloric music competition that will take place in the open air amphitheatre of Quinta Vergara in Viña del Mar, Chile. The Festival takes place from the 21st until the 26th of February 2011 and is based on the following principles:
1. OBJECTIVE:
The main objective of The International Singing Festival of Viña del Mar 2011 is to develop and encourage music of popular and folkloric roots in Chile and in the world. In turn, it seeks to be a platform of exhibition and recognition for every writer, composer and interpreter who has an outstanding musical work. Hereby, the Festival of Viña del Mar 2011 is a competition that seeks to recognize Chilean and international folkloric music and its importance in the world, and looks forward to promote a cultural exchange between the participating countries.
2. INVITACION:
This 2011, The Promotion Committee of the Festival of Viña del Mar 2011 invites every Author, Composer and interpreter, Chilean and foreign in general, to take part in the process of selection of the foreign songs and Chilean song that will compete in the folkloric competition, at the 52nd International Singing Festival of Viña del Mar 2011.
The selection procedure of the songs for the Folkloric Competition and everything concerning the participation of Chilean and foreign interpreters should follow along these regulations.
These regulations will be published in one (1) daily national newspaper and, in a permanent form, on the websites
www.chilevision.cl and www.vina2011.cl, as also across the record companies with headquarters in Chile.
In the foreign countries the announcement will be spread through a press release to the mass media, Author Societies, and musical companies, with the bases attached. Its diffusion will be realized by the Author Societies, embassies or consulates of Chile in the world, and on the following websites: www.chilevision.cl.
3. PARTICIPATING SONGS:
A total of six (6) songs will participate at the Folkloric competition in the 52nd International Singing Festival of Viña del Mar 2011, of which five (5) songs are foreign and one song is Chilean.
The nationality of a song’s author, according to these regulations, will determine to which country the song belongs. If there are co-authors involved, the authors participating in the
registration form should indicate the nationality of any one of these authors with the purpose of establishing the country that the song will represent.
The nationality of the interpreter shall not be considered for the purposes of determining the country to which the song represents.
The registration of all songs taking part in the Folkloric competition of the 52nd International Singing Festival of Viña del Mar 2011 must have the following requirements:
3.1 All the songs that take part in the Folkloric Competition must not have taken part in any international festival and /or national competition previous to February 21, 2011.
3.2 The songs must not exceed three minutes and thirty seconds of duration.
3.3 The author and/or composer may register a maximum of two (2) songs, and only one of them will be selected.
3.4 No employee that in any way is related to the organization or development of the 52nd International Singing Festival of Viña del Mar 2011 can participate as a competitor. Neither can relatives until the fourth direct degree in family line nor other close relations.
This article could serve as enough ground to disqualify a song or songs that are related to people that do not respect this rule.
4. INSCRIPTION
The authors, composers and interpreters who want to participate in the 52nd International Singing Festival of Viña del Mar 2011 must register their songs following the requirements bellow:
4.1 The postulations to compete in this competition must be sent, along with all the background required in point 4.3., by email or personally delivered to any of the following addresses:

4.2 The limit date to receive the postulations of the songs will be: October 22, 2011 at 12: 00 hrs.
4.3 Each author and/or Chilean and foreign composer shall include mandatory, at the time of registration, the following requirements:
a) A registration form (Declaration sworn and/or legalized) attached to these papers of regulations, with the updated background that they request. For the purposes of this contest the registration form duly signed by the author (s), composer (s) and artist (s) will have the value of a sworn statement.
In case of a deceased author or composer, who presents the song must attach a document signed before a public notary or a similar Faith Minister according to the place where granted, of the members of the succession of the deceased which authorize the use of the work.
b) A document certifying the registration of the work in the Intellectual Property Registry and/or the Author Societies of the country it represents, indicating the author and composer.
In the event that the song is not submitted by the original author, the person shall certify the express authorization of the use of the work by third parties. Such authorization shall have been granted before notary or a competent faith Minister.
c) Ten (10) copies of the letter printed in Office Word format. If the song uses a foreign language or a native dialect (other than the Spanish), a translated version in spanish must be sent.
d) A Compact Disc (CD) containing copies of the master song's recording. This recording must be of professional quality, in techniques that allow the production team to make a phonogram of the CD. The production of the Festival of Viña del Mar 2011 and channel Chilevisión reserve the right to apply the faculties referred in the ninth section of the present regulations.
e) A short biography of the author, composer and interpreter (maximum one page).
f) Promotional photographs of the composer, author, and interpreter, printed and in digital format. The printed pictures must follow a format of 18 x 24 cm, minimum one (1) black and white and one (1) in color. If the photograph is in a digital format (jpg), the file must be accompanied with a printed copy of these 18 x 24 cm.
5. SELECTION
5.1 Foreign songs
In the 52nd International Singing Festival of Viña del Mar, foreign participating songs will be selected according to the following procedure:
A Committee elected by the Promotion Committee of the International Singing Festival of Viña del Mar 2011, conformed by executives of the channel, personalities with experience in the folkloric gender and a member of the Municipality of Viña del Mar, will select five (5) countries to participate in the competition. For each country they will select one (1) song from the public open call, and the invitations made. These songs will directly participate in the folkloric competition of the 52nd International Festival of Viña del Mar 2011.
The choice of these countries and the songs nominated for the Folkloric Competition will be agreed upon the members of this Committee who will select in discretion the songs that have completely fulfilled the requirements set out in the present regulations.
5.2 Chilean Song
The Chilean Song participating at the 52nd International Singing Festival of Viña del Mar 2011 will be selected according to the following procedure:
A Committee elected by the Promotion Committee of the 52nd International Festival Song of Viña del Mar 2011, conformed by executives of the channel, personalities with experience in the folkloric gender and a member of the Municipality of Viña del Mar, will select in discretion the song that will come from the public open call and the invitations made, that have completely fulfilled the requirements set out in the present regulations.
6. ORCHESTRA AND CHORUS OF ACCOMPANIMENT
6.1 The songs selected to participate in the Folkloric competition of the Festival, must be interpreted together wit the “Official Orchestra and Choir” that will be in charge of the Musical Director of the 52nd International Singing Festival of Viña del Mar 2011. The characteristics of the instrumental formations and the choir will be announced to the invited participants in time.
In the event that competitor decides that the Orchestra is directed by a different music director than the official one, he must formally apply for it to the production of the Festival.
6.2 Chilean and Foreign competitors selected shall deliver to the production of the Festival a list with the instrumentation or orchestration necessary for his/her performance. The date to report the Musical director of the festival the orchestral and/or choral requirements begins three days after the selection of the participating songs is made until January 05, 2011.
6.3 If one of the competitors wants to add an instrument to have a better performance, that isn’t included in the standard equipment of the Official Orchestra and Choir, this could be added, only and always with approval of the Musical Direction of the Festival of Viña 2011. All costs arising under this heading shall charge to the competitor, as also the musician (s) performer (s), which aren’t registered in the "registration form".
For this effects, Chilean and foreign Composers and/or authors will have till 05 January 2011 to make available to the Director of the Orchestra of the Festival the orchestral arrangements in the orchestral equipment.
However, the Production of the Festival of Viña 2011 reserves the right to accept or deny the request to add any extra instrument for the convenience of the show.
6.4 The Musical Director of the Festival of Viña 2011 will take responsibility of composing the necessary orchestra and musical tools for realizing the songs that will be sung on the competitions. The Musical director will make his best effort to create an orchestration that demonstrates the musical value of the song and highlight the artistic status of its interpreter.
6.5 .5 Once selected the songs, each interpreter may have a musical sequence support (in a professional quality) with the final version of the song to be used in the presentations, together with the "Official Orchestra and Choir", during the week of the folkloric competition at the Festival of Viña del Mar 2011. The decision to include it or not, shall be exclusive faculty of the production of the Festival of Viña del Mar 2011.
6.6 Songs taking part in the competition shall be performed live in the language that the author created the composition, not necessarily the original language of the country that the artist was born.
7. THE INTERPRETRS
For the purposes of this competition, interpreter is the person who sings the song (vocally), and he/her must comply with the requirements listed below:
7.1 He/her must have a minimum age of 16 years old from October 22, 2011.
7.2 He/her must have the nationality of the country he/her represents.
7.3 He/her can be a known artist or a popular figure.
7.4 Interpreters can be vocalists, musicians or both.
7.5 All interpreters (maximum five members), must be duly identified in the "Registration Form".
8. INTERPETATION
The interpretation of the songs participating in the folkloric competition shall be subject to the following rules:
8.1 Al participating songs will be interpreted live, at least 2 times during the competition of the Festival of Viña del Mar 2011.
8.2 None of the vocalist or instrumental interpreters can perform in the “Official Orchestra and Choir” sector.
8.3 The interpreter of the participating song designated in the registration form, in accordance with the preceding number 4.3 may not be replaced, without prior authorization written by the Commission.
8.4 The order and dates of the performance of the songs sung at The Quinta Vergara Theater will be determined by the Production of the Festival of Viña 2011, according to the artistic and technical regulations.
9. THE RIGHTS
Chilevisión shall be owner of the exclusive rights of execution, publication, projection, presentation, reproduction, synchronization, transmission, retransmission, communication to the public, including making available by all kinds of digital media, distribution and/or marketing, nationally and internationally every work, resulting from the participation of the contestants of the folkloric competition, either in free reception system television, analog or digital, limited systems of television, international signal, signal IP, broadcasting services or other means of communication, including its execution, publication, projection, presentation, reproduction, communication to the public, including the provision and/or transmission via Internet, mobile phones, and on digital platforms, and using the image of the / the authors, composers and interpreters by all means.
In particular, and without the enumeration which continues to be binding or exhaustive but merely enunciative, Chilevisión is expressly authorized to:
1. Transmit live, both in Chile and in foreign countries, by free reception televisions system, analog or digital television, limited television services, international signal, signal IP and/or radio broadcast and/or other media system, including Internet and mobile phones, which it designates or contracted, without limitation, the presentation of the participants in the Festival.
2. Make the re- airing of the show by free reception television system, analog or digital, limited television services, international signal, signal IP, radio broadcasting services or by other means of communication, including Internet and mobile phones, recordings, editions and adaptations of the songs participating, referred in N°1 above, including the interpreters, in Chile and in foreign countries, through Chilevisión signals and/or channels or systems and signals that Chilevisión appoint or hire, by an unlimited number of times and the maximum term of legal protection services.
3. Make the recording, playback, editing, transformation and adaptation of the resulting interpretations of the participants at the folkloric competition of the Festival, in any material supports, allowing the re-transmition on television, radio or other means of communication, or adaptations, either by free reception and/or limited television,
International signs, signals IP, broadcasting services or other media, including Internet and mobile phones services television systems.
All fixation material and support of images and/or sounds on any base material of the audiovisual work that the participants intervene, directly or indirectly in the pursuance of the present rules, are and will only be of exclusive property of Chilevisión.
10. ORGANIZATION
The participants of the Folkloric competition will receive from Chilevisión, the following:
10.1 Accommodations
Accommodation for the singer(s), maximum five (5), in the place the production team decides, for a maximum of ten (10) days, during February 2011, in which the festival will take place. Additional services such as phone calls, room service or other similar are not included.
10.2 Catering
Catering for the singer (s), in the place the production team decides, for a maximum of 10 days during February 2011, as long as this competitor participates at the Festival. Extra consuming, as minibar and others, are not included.
10.3 Transport
Each of the foreign performers, duly registered in the "registration form", will receive a ticket in economy class between their country of origin and Santiago de Chile, one-way and return. Airlines or other means of transport shall be determined and allocated by the production of the Festival of Viña 2011. The payment of fees for shipping or taxes that are not included in the passage of foreign artist will be responsibility of the production team. Taxes by the concept of leaving their country and charges for overweight baggage will be responsibility of the participant.
For Chilean participants, transportations from their own city and Viña del Mar will be supplied. The airlines and other transportation company will be determined by the production of the Festival de Viña 2011.
Once the competitors agree with the Production of the Festival of Viña del Mar 2011, about the flight ticket and itinerary, any name, date, airline or transportation company change is by their own account and will have to be modified and paid by themselves.
10.4 Others
The Production of the Festival of Viña 2011 has a permanent medical first aid insurance. In case a medical emergency occurs on stage or anywhere else, the organization will not pay for medical expenses and hospitalization of the interpreter. Therefore, it’s the interpreter’s
obligation to have an international health insurance contracted in his country before his visit to Chile.
Chilevisión will not grant credentials, nor pay hosting or catering, nor passages to persons accompanying the interpreter different from the above, or companions of authors, composers or Orchestra directors.
11. THE JURIES AND PRIZES
11.1 Jury
The Committee will designate a unique jury for the international and the folkloric competition. The jury shall consist of an odd number of personalities from recognized and vast experience in the artistic field - musical and international and folkloric gender, who will determine the winning songs of the contest in the Quinta Vergara.
The final vote of the jury in the Quinta Vergara shall be certified by a public notary.
The members of the jury will emit their votes by means of an electronic system that allows the qualifications given to the participants to be known immediately, by the audience and by the artists in the Quinta Vergara.
11.2 Qualification and selection of winners
Each Member of the jury will qualify the artists with notes from 1 to 7, during the transmission.
In the finals of the Folkloric competition, only three (3) songs will be presented with the best average score obtained by the jury’s qualification, between the six (6) participating songs. They will be qualified live by the jury with the same voting system already mentioned in these regulations in the point 11.1 precedent.
The Song that gets the best score during the final night of the Folkloric competition will be the winner of the competition.
In case there is a tie in the selection of the finalists or in the finals, the President of the jury will decided live and directly to the public and artists, who will be the finalists and/or the winner.
Any Decision and/or qualification of the jury may not be challenged by the participants.
11.4 Prizes
The author (s) and/or composer (s) of the "winning song", will receive a price of UF 739 (Seven hundred and thirty-nine units of foment) or its equivalent in national currency and the “Silver Sea-Gull”, symbol of the Festival. If the author and the composer are different
persons, each one of them will receive a “Silver Sea-Gull”, symbol of the 52nd International Singing Festival of Viña del Mar 2011.
The interpreter (s) of the “winning song” of the Festival of Viña del Mar 2011 will receive a price of 1UF 246 (two hundred and forty-six units of foment) and the “Silver Sea-Gull”, symbol of the 52nd International Singing Festival of Viña del Mar 2011.
The event organizers assume no responsibility in tax matters in relation to the awards.
In what is referred to obtaining the price, in case the author or composer is not present at the place of the event, the price will be handed over to the Author’s Society of the work’s nationality. If this is not possible conform these regulations, a representative will be appointed to diplomatically represent the song’s nationality.
If in any circumstance the representative of the author or composer is absent at the place of the event, he or she will be replaced by the song’s interpreter who will have the mission to hand over the price to the author or composer or any of the descendents in case the first past away.
12. ACCEPTANCE OF THE PRESENT REGULATIONS
By participating at the 52nd International Singing Festival of Viña del Mar 2011, the interprets will accept the decision taken by the Promotion Committee, the Festival’s Production team and jury’s verdict, as mentioned in this regulation, resigning openly from any possible action that opposes this. Also, this implies an acceptance of the event’s characteristics, its structure and its organization.
All decisions taken by the Production team of the Festival of Viña del Mar 2011, by people related to the organization and development of the event and the decisions taken by the jury mentioned in this regulation are irrefutable and not susceptible to any complaint against the organization. Any doubt related to the application or interpretation of these regulations will be resolved by the Production team of the Festival de Viña del Mar 2011.
Any complaint concerning of a person or entity related to authorial property of the competing songs or violation against these regulations must be sent in written form to the Executive Secretary of the Festival’s Promotion Committee within 15 days before the beginning of the Festival of Viña del Mar 2011. Also, the complaints filed must be accompanied by proof that categorically shows any irregularity or plagiarism and the Festival’s Promotion Committee could revise the proposal until 5 days before the beginning of the Festival.

The Production of the Festival of Viña del Mar 2011 reserves the right to suspend, at any point, any act or presentation that goes against these regulations. With the same right, the Committee can, exclusively, modify the dates clarified in these regulations.
13. OTHERS
Songs and documents received will not be returned, as well as photos, CD and other documents attached to the registration form.
The Production team of the Festival of Viña del Mar 2011 and the Festival’s Promotion Committee will be the only entities responsible for assuring a strict fulfillment of the actual criteria.
In case of any violation of any of these articles, the participating interpreters will see themselves obliged to return to Chilevisión the total amount of costs incurred by the company coming forth out of participation at the festival.
14. DEFINITIONS
Author: person that has written the original lyrics of the song.
Composer: Person that has composed the original music of the song
Interpreter: Person that sings the song (vocalist).
Competitors or Participants: The group composed by interpreter(s), author(s), and/or composer(s).
